General
This privacy statement sets forth the Accredited
Capital Corp. (ACC) policies, rules and procedures
governing its collection, use and disclosure of personal information.
This policy statement is deemed to be part of the Terms and Conditions
of this ACC web site (the Site) and they must be read
together.
We thank you for your interest in the ACC Site.
Please read the privacy statement below (the "Privacy Statement")
carefully before using the Site. By using the Site, you confirm
your acceptance of the terms of this Privacy Statement. If you
do not agree to the Privacy Statement, please do not use the Site.
We reserve the right, at our sole discretion, to modify the Privacy
Statement at any time, and such modifications shall be effective
immediately upon posting of same on the Site.
ACC takes commercially reasonable precautions to
ensure your privacy on the terms contained in this Policy Statement,
however, we cannot totally prevent, unintended disclosures by
such means as hackers and other unauthorized individuals, and
inadvertent or illicit employee actions.
All ACC customer information, such as client names,
addresses, records of transactions, portfolio performance reports
and information used to verify the customer (collectively, the
"Data") is kept confidential in accordance with the
following guidelines. ACC limits the collection and retention
of information about its customers primarily to what ACC is required
to know to in order to be compliant with its Know Your Customer
Policy obligations, to complete a requested transaction on behalf
of clients, administer client accounts, to provide customer service
and/or to fulfill any applicable legal and/or regulatory requirement.
Access to customer Data by ACC employees is limited to those employees
who specifically require the Data to conduct legitimate business
needs and who have authority to access such Data.
Certain Data is shared with ACC business partners
necessary to complete client investment objectives, including,
without limitation, clearing houses, payment banks, administrators
and processors, and financial institutions. These business partners,
and not ACC are responsible for their own privacy polices and
for maintaining privacy and confidentiality for all information
provided to them. If a user has any questions or concerns about
the privacy policies of those parties, it must contact such parties.
Security
ACC uses advanced technology to help ensure that customer Data
is processed accurately, promptly and completely. All customer
account numbers are stored on a computer server that is not connected
to the Internet. This computer server is not accessible by modem.
Further, ACC makes use of encryption and digital signatures to
further protect the privacy of its customers.
Compelled Disclosures
When a court order or subpoena (collectively, an "Order")
requires ACC to release information, subject to the terms of the
Order, ACC endeavors, if possible, to contact the client to permit
them to exercise any legal rights he or she may have. Exceptions
to this practice exist if for instance ACC is prohibited by the
Order or applicable laws from notifying the client, or if fraud
and/or criminal activity are suspected. In the event that ACC
believes, acting reasonably, that any person wishing to establish
an ACC account or to complete a transaction using, with or to
an ACC account or related product or account, as the context requires,
is using funds, or monies derived from a criminal origin or is
a part of a money laundering scheme or activity, either individually
or taken as a whole, ACC will, without notice to such persons,
and in compliance with applicable laws, report such person and
activity to the appropriate authorities and may in its sole discretion,
refuse to establish any respective account and/or complete any
such transaction.
Tracking Of Visitors To The ACC Internet Site
The Site keeps track of data, such as the source
address that a page request is coming from, your IP address or
domain name, the date and time of the page request, the referring
web site (if any) and other parameters in the URL. The IP addresses
we collect on transfer services are linked to personally identifiable
information or Data. The user may however voluntarily supply ACC
with personal information for such purposes as requesting to become
a client or receiving correspondence. ACC may however gather certain
limited non-personal information about usage of the Site by monitoring
for instance the number of visitors to the Site, the popularity
of various pages on the Site or the downloading of information
from the Site.

to the Site is treated as non-confidential and non-proprietary.
